Stubborn Seller Won't Move Out?


I am buying a house in Pleasanton, and the contract is signed and the escrow is getting ready to close, and the seller decides he does not want to move out at close of escrow, but wants a week after close to move out. When we express the fact that this will not work for us, he threatens to cancel the contract. Can he do this? Ben in Pleasanton

Confusion on Commission Agreement?


Doug, my friend listed her house with an agent with the understanding that if one of her friends (named specifically) buys her property, the agent would be compensated at 4% commission. So one of her friends has made an offer. When the agent sent my friend the estimated pay out from the transaction, the agent put in her commission as 6%. Her explanation is that the original deal was only good until she listed the house in MLS. Is this ethical? Or legal? Or standard practice? Ginny C.

Seller Rent Back turns into nightmare?


I recently purchased my first house and according to the escrow agreement the seller received 3 days after closing to move. Well after three days I called the seller to verify a time we would meet to exchange keys and he told me he needed THIRTY days!!! To make a long story short he claims he didn't understand the escrow docs and thought he had more time. So I charged him $4000 for the additional 30 days. Now we're coming close to the end of the thirty days and he STILL isn't prepared to move. Although, I'd love to milk him for another $4000 I'm ready to move into my place. About Me

I am a sucessful Real Estate Broker with Alain Pinel Realtors. With over 17 years experience, I service the Pleasanton, Dublin, San Ramon, Danville/Alamo, and Livermore areas. I have a strong track record of success and a long list of satisfied clients. I have several web sites listed in the RESOURCES section that can tell you all about my services, my properties, my marketing, my experience, yada yada yada. In short… yeah, I sell homes. And my cients tell me I am very good at it.

I am a also a writer, and an active pundit for real estate, political, and lifestyle issues in the Tri-Valley. I possess a strong sense of humor and sense of irony. I have been published in the Contra Costa Times.

I am a husband, and father of 2 awesome kids. I have 2 cats, but I don’t really like them because they ignore me, and I am allergic to them, and they don’t fetch things when I throw them (I’m more of a dog person)

I am a musician, and play fairly regularly in the East Bay with my band The Crisis, which is an ecclectic 40 something rock/accoustic/funk/alt country band that plays KFOG type of music. And yes, we do get paid to do it, although it does not pay nearly as well as my real job.

I am involved in the community. I have coached little league for years, as well as soccer and occaisionally basketball. I have served on the the Parent Board for the local elementary school and the local little league. I am currently the president of the local high school Athletic Boosters, so I am very involved in local schools and sports.

I love living in the Tri-Valley. It is an awesome blend of the best of suburbia (lots of safe neighborhoods) and the energy and drive of silicon valley. And when I want a more urban environment, I can take BART into the city, or head up to Walnut Creek, Rockridge, or Berkeley and get more of that cool urban experience. I love great wine and great restaurants, and small coffee shops along Main St, and working out at ClubSport (spin classes are a personal favorite). And no, I don’t like taking long walks on the beach (stepping on broken shells with your bare feet). In short, this area offers the best of everything, and if it is not here in the Tri-Valley, then it is usually just a car ride away (Tahoe, Yosemite, Santa Cruz, The Redwood Country, The Coast, Monterey, etc etc etc).
